A title insurance policy protects you and/or the lending institution in the event that your ownership and/or rights to a property are challenged. Before buying any property, clean title is a must. It is always the choice of the buyer or in the event of a refinance, the current owner, as to which title company or agent they would like to use.
A title search tells the story of the property and it’s owners via historical public records, including deeds, mortgages, and court records as well as other public documents. A title commitment is prepared which includes an examination of this information and the proper disposal of any encumbrances on the property, such as unpaid taxes or liens, outstanding mortgages, judgments, utility or other easements, and any other restrictions. The insurance policy is produced after the closing insuring that all matters affecting title have been properly cured.
